This Software License Agreement (“Agreement”) is a legal contract between SkillStride Ventures (OPC) Pvt Ltd, a company incorporated under the laws of India, with its registered office at 3rd Floor, Chitrahar Building, above Tealogy, Naval Kishore Rd, Hazratganj, Lucknow, Uttar Pradesh 226001, India (“Licensor,” “We,” or “Us”), and the individual or entity purchasing and installing the software (“Licensee,” “You,” or “Your”).
By purchasing, downloading, installing, or using the Exam Frame software (“Software”), You agree to be bound by the terms and conditions of this Agreement. If You do not agree to these terms, do not purchase, download, install, or use the Software.
1. DEFINITIONS
1.1 Software: Refers to Exam Frame, an online examination system developed by SkillStride Ventures (OPC) Pvt Ltd, including all updates, patches, and documentation provided by the Licensor.
1.2 License: The non-exclusive, non-transferable right granted to You to install and use the Software on a self-hosted server as per the terms of this Agreement.
1.3 Support: Technical assistance provided by the Licensor, including 1 year of free support with the Software purchase and 10 days of support for bug fixes related to paid customization orders, as detailed in Section 5.
1.4 Documentation: Any manuals, guides, or instructions provided with the Software.
1.5 Open-Source Components: Third-party software components included in the Software, such as Laravel 11, licensed under their respective open-source licenses (e.g., MIT License).
2. GRANT OF LICENSE
2.1 License Grant: Subject to the terms of this Agreement and payment of the applicable license fee, Licensor grants You a non-exclusive, non-transferable, revocable license to download, install, and use the Software on a single self-hosted server owned or controlled by You for the purpose of conducting online examinations and mock tests. The Software is provided with its source code accessible to You for self-hosting and customization.
2.2 Scope of Use: This License permits You to use the Software for Your internal business or personal purposes. You may not sublicense, rent, lease, or distribute the Software to third parties unless expressly permitted in writing by the Licensor.
2.3 Ownership: The Software and all intellectual property rights therein, excluding Open-Source Components, remain the sole property of SkillStride Ventures (OPC) Pvt Ltd. This Agreement does not transfer ownership of the Software to You.
3. PAYMENT AND DELIVERY
3.1 License Fee: The Software is provided in exchange for a one-time license fee as specified on EduExpression.com at the time of purchase. All fees are non-refundable due to the downloadable nature of the Software and the availability of its source code.
3.2 No Refunds: No refunds will be provided under any circumstances. To ensure satisfaction prior to purchase, Licensor offers a full demo of the Software and live chat support via WhatsApp (reachable at +91-8881642322) for pre-purchase inquiries.
3.3 Delivery: Upon successful payment, You will be provided with a downloadable copy of the Software, including its source code, via the website or email. You are responsible for installing the Software on Your server.
4. RESTRICTIONS
4.1 Prohibited Actions: You may not:
a. Reverse-engineer, decompile, or disassemble the Software’s compiled components, except as permitted by applicable law or the licenses of Open-Source Components.
b. Remove, alter, or obscure any copyright, trademark, or proprietary notices included in the Software.
c. Use the Software to provide commercial hosting services to third parties without prior written consent from the Licensor.
d. Distribute, sell, or transfer the Software or Your License to any third party, except as permitted under Section 4.2 below.
4.2 Single Instance: This License permits installation and use of the Software on only one server. Additional installations require separate licenses. You may modify the source code for Your own use but may not redistribute or sell the modified Software without Licensor’s written consent.
5. SUPPORT
5.1 Standard Support: Licensor will provide free technical support for the Software (“Standard Support”) for a period of 1 year from the date of purchase. Standard Support includes assistance with installation, bug fixes, and minor issues related to the base Software, delivered via email (help@etymoengine.com). It does not include custom development, server configuration, or troubleshooting issues caused by Your hardware, network, or third-party software.
5.2 Customization Support: For any paid customization orders (e.g., custom feature development requested by You and paid separately), Licensor will provide support for bug fixes related to the custom features (“Customization Support”) for a period of 10 calendar days from the delivery of the customized Software.
5.3 No Updates: Unless explicitly stated at the time of purchase, this Agreement does not entitle You to updates, patches, or new versions of the Software beyond the Standard Support period.
6. OPEN-SOURCE COMPONENTS
6.1 Inclusion: The Software incorporates Open-Source Components, including but not limited to Laravel 11, which are governed by their respective open-source licenses (e.g., the MIT License).
6.2 Licensee Obligations: You are responsible for complying with the terms of these open-source licenses when using or modifying the Software.
7. TERM AND TERMINATION
7.1 Term: This Agreement is effective upon Your purchase of the Software and continues until terminated.
7.2 Termination: Licensor may terminate this Agreement if You breach any term herein.
8. WARRANTIES AND DISCLAIMERS
8.1 Limited Warranty: Licensor warrants that the Software will function substantially as described for 30 days from the date of purchase.
8.2 Disclaimer: Except as expressly stated herein, the Software is provided “AS IS” without warranties of any kind.
9. LIMITATION OF LIABILITY
9.1 Exclusion of Damages: Licensor shall not be liable for any indirect, incidental, consequential, or punitive damages.
9.2 Liability Cap: Licensor’s total liability under this Agreement shall not exceed the license fee paid by You.
10. GOVERNING LAW AND DISPUTE RESOLUTION
10.1 Governing Law: This Agreement shall be governed by the laws of India.
10.2 Jurisdiction: Any disputes shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh, India.

BY PURCHASING, DOWNLOADING, INSTALLING, OR USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT.
